1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you", "your", "user") and Goblin And Wizard ("we", "us", "our") governing your access to and use of all mobile applications, games, and digital products published under the Goblin And Wizard name (collectively, the "Services"), including but not limited to Cascade, QuizEveryday, and any future applications.

By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

2. Eligibility

You must be at least 13 years of age (or such higher minimum age as may apply in your jurisdiction) to use our Services. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request verification of age at any time and to terminate access to the Services if we believe a user does not meet the minimum age requirement.

3. Licence Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use our Services on compatible devices that you own or control, solely for your personal, non-commercial use.

This licence does not grant you any right to, and you shall not:

  • Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Services
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Create derivative works based on the Services
  • Distribute, sublicence, lease, rent, loan, or otherwise transfer the Services to any third party
  • Use the Services for any commercial purpose without our prior written consent
  • Use the Services in any manner that could damage, disable, overburden, or impair our servers or networks
  • Use any automated means, including bots, scrapers, or scripts, to access or interact with the Services
  • Exploit bugs, glitches, or unintended features for unfair advantage in games or to manipulate leaderboards

4. Intellectual Property

All content within our Services, including but not limited to software code, graphics, artwork, animations, sounds, music, text, game mechanics, user interface designs, and trade names, is the exclusive property of Goblin And Wizard or its licensors and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

The Goblin And Wizard name, logo, and all related product and service names, design marks, and slogans are trademarks of Goblin And Wizard. You are not authorised to use any such marks without our prior written permission.

5. In-App Purchases and Virtual Items

Our Services may offer in-app purchases, including but not limited to virtual currency, virtual items, premium content, subscription services, and the removal of advertisements (collectively, "Purchased Content"). All in-app purchases are processed through the Apple App Store or other applicable platform payment systems and are subject to the terms and conditions of those platforms.

All purchases are final and non-refundable, except as required by applicable law or the refund policies of the applicable platform. Purchased Content is licensed to you and not sold. We reserve the right to manage, modify, or eliminate Purchased Content at any time, with or without notice.

Virtual currency and virtual items have no real-world monetary value and cannot be exchanged for cash, goods, or services outside of our Services.

6. User Conduct

You agree to use our Services in a manner consistent with all applicable local, national, and international laws and regulations. Without limiting the foregoing, you agree not to:

  • Use the Services to harass, abuse, threaten, or intimidate other users
  • Transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to gain unauthorised access to the Services, other user accounts, or computer systems or networks connected to the Services
  • Use the Services to distribute spam, chain letters, or unsolicited communications
  • Engage in cheating, hacking, or use of unauthorised third-party software that modifies or interferes with the Services

7. User-Generated Content

Certain features within our Services may allow users to submit, upload, share, or otherwise make available content, including but not limited to scores, usernames, and messages ("User Content"). You retain ownership of any intellectual property rights in your User Content, subject to the licence granted herein.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the operation and promotion of the Services.

You represent and warrant that you have all necessary rights to grant this licence and that your User Content does not infringe the intellectual property or other rights of any third party.

8. Availability and Updates

We reserve the right to modify, update, suspend, or discontinue any or all of our Services, in whole or in part, at any time, with or without notice and without liability to you. We may also release updates to the Services which may include bug fixes, feature enhancements, or security patches. You acknowledge that continued use of the Services may require you to install such updates.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT WITHIN THE SERVICES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOBLIN AND WIZARD, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party within the Services
  • Any content obtained from the Services
  • Unauthorised access, use, or alteration of your content or data

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (GBP 100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Goblin And Wizard and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any User Content you submit through the Services.

12. Termination

We may terminate or suspend your access to the Services, in whole or in part, at any time and for any reason, including without limitation if we reasonably believe you have violated these Terms. Upon termination, your licence to use the Services will immediately cease, and you must delete all copies of the Services from your devices. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4, 9, 10, 11, and 14.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms shall affect any statutory rights that cannot be waived or limited by contract under applicable law.

14. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Goblin And Wizard regarding the Services and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on this page, with an updated "Last Updated" date. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.
